On Amendments to the decision of the Board of the Eurasian Economic Commission dated December 25, 2012 N 293

In accordance with paragraph eight of paragraph 5 of the Protocol on Technical Regulation of the Eurasian Economic Union (Annex N 9 to the Treaty on the Eurasian Economic Union of 29 May 2014) and paragraph 9 of the annex N 2 to the Rules of the Eurasian Economic Commission approved the decision of the Supreme Eurasian Economic Council on December 23, 2014 N 98, the Board of the Eurasian economic Commission

I decided:

1. Amend the decision of the Board of the Eurasian Economic Commission dated December 25, 2012 N 293 "On the common forms of the certificate of conformity and declaration of conformity with technical regulations of the Customs Union and the rules of their registration" changes according to the application.

 

2. To establish that:

a) The forms of certificates of conformity with the technical regulations of the Customs Union, issued before the entry into force of this Decision, are used along with forms, made with the changes provided for in paragraph 1 of this Decision until 1 January 2019;

 

b) the certificates of conformity and declaration of conformity with the technical regulations of the Eurasian Economic Union (CU), issued and registered before the entry into force of this Decision, are valid until the expiry of their validity.

3. This Decision shall enter into force after 30 calendar days from the date of its official publication.

II. Guidelines for issuing the certificate of conformity requirements of technical regulations of the Eurasian Economic Union

1. Certificate of compliance with the technical regulations of the Eurasian Economic Union (hereinafter respectively - certificate Union) issued by the certification included in the single register of conformity assessment bodies of the Union.

 

2. If certification applicants may be registered in accordance with the legislation of the state - member of the Union (hereinafter - Member State) in its territory a legal entity or natural person as an individual entrepreneur, is a manufacturer or seller or a person authorized by the manufacturer (hereinafter - applicants).

 

3. Forms of the certificate and its annexes are documents of strict accountability, are manufactured in the Member States in hard copy and have at least 4 degrees of protection, including:

a) giloshnuyu frame a positive image;

 

b) micro text placed along the perimeter of the frame giloshnoy;

 

c) a protective translucent holographic element;

g), typographic number consisting of a series of blank, 2-digit alpha code of the Member State (in accordance with the classifier of the world) and the serial numbers of the form (7 Arabic numerals).

4. The certificate is filled in Russian using electronic printing devices, and in case of corresponding requirements in the legislation of the Member State - in the official language of the Member State in which the product certification.

In the case of filling a certificate in Russian and the official language of one of the Member States it is filled in accordance with paragraph 6 of this Section on different sides of the certificate.

If necessary, the manufacturer's name, its location (address of the legal entity) and address (es) of the place of activity for the production of products (except for the name of the state) and the designation of the product (type, make, model, article, etc.) Can be specified using the Latin alphabet.

5. All fields must be filled out certificate (in the original numbering of the certificate no fields).

 

6. The certificate shall state:

a) Field 1 - inscriptions formed in two rows in the following order: 1st row - "Eurasian Economic Union";

Line 2 - "Certificate of Conformity";

b) Field 2 - a single sign of products on the market of the Eurasian Economic Union;

 

c) in the 3 - the registration number of the certificate, which is formed in accordance with the legislation of the Member State, indicating the abbreviation "EAEC" (Eurasian Economic Union) and the 2-character alphabetic code of the Member State in accordance with the classifier of the world;

g) in the 4 - typographic certificate form number provided by subparagraph "d" of paragraph 3 of this section and shall in the manufacture of the blank;

d) in the field 5 - the full name of the certification authority that issued the certificate, its location (address of the legal entity), and the address of place of business (if the address is different), the registration number and date of registration of the certificate of accreditation of the certification body, and telephone number and email address;

e) in the 6 - the applicant's full name, its location (address of the legal entity) and address (es), place of business (if the address is different) - for a legal entity or surname, name and patronymic (if any), place of residence and address (es), place of business (if the address is different) - physical person registered as an individual entrepreneur, as well as the registration or accounting (individual, identification) number of the applicant, assigned the state registration of the legal entity or natural person registered as an individual entrepreneur, in accordance with the laws of the Member States, phone number and email address;

g) in the 7 - full name of the manufacturer and its location (address of the legal entity) and address (es) of the place of preparation of production activity (if the address is different) - for a legal entity and its affiliates which are manufactured products, or surname name and patronymic (if any), place of residence and address (es) of the place of production on manufacturing activity (if the address is different) - physical person registered as an individual entrepreneur;

 

h) in the 8 - data on products, including:

name and designation (in cases stipulated by the technical regulations of the Union (the technical regulations of the Customs Union) (hereinafter - the Technical Regulations)) products and (or) other symbol assigned to the manufacturer of the product (if any);

product name (in cases stipulated by technical regulations) (if any);

other information about the product, to ensure its identification (if any);

name and designation of the document (s), according to which the products are made (standard, organization standard, specifications or other documents) (if any);

the name of the certification object (serial production, a party or a single product). Write "serial production" is made for the production of serial production. For a lot of the product is specified lot size for a single product - the serial number of the product. For a lot of the product and the individual products are specified the details of shipping documentation identifying the batch of products (including its size) or a single product;

and) in the 9 - code (s) of production in accordance with the Single Commodity Nomenclature of Foreign Trade of the Eurasian Economic Union;

a) in a field 10 - the name of the technical regulation (technical regulations);

l) in the field of 11 - data on documents confirming the conformity of products with technical regulations (technical regulations) (research protocols (tests) and measurements (in cases stipulated by the certification scheme) with the number, the date, the name of the testing laboratory (center), registration number of accreditation certificate), the information on the certificate of analysis of production conditions (in cases stipulated by the certification scheme), the certificate management system (in cases stipulated by the certification scheme) with the number, date, name of the body for management systems certification, issued the certificate management system, registration number of the certificate of accreditation, information on the conclusion of the project research products (in cases stipulated by the certification scheme) with the number, date, name of the organization issuing the opinion on the draft study, production, registration number certificate of accreditation, on the conclusion of the study, the type of product (in the case envisaged certification scheme) with the number, date, name of the organization that issued the conclusion of the study product type, registration number of accreditation certificate, other documents submitted by the applicant as proof of conformity with technical regulations (technical regulations), as well as the application of the scheme certification;

 

m) in the 12 - Designation and standard name included in the list of international and regional (interstate) standards, and in their absence - the national (state) standards, as a result of which, on a voluntary basis, compliance with the requirements of technical regulations (technical regulations) or designation of the sections (paragraphs, subparagraphs) and the name of the standard, if the compliance with technical regulations (technical regulations) can be achieved using the individual sections (paragraphs, subparagraphs) of the standard, not the standard as a whole (in the case of their use), and well as information on other standards and documents (when applied), the terms and conditions of storage (in the cases stipulated by technical regulations), Lifetime (shelf life) or resource production (in cases stipulated by technical regulations) and other information (if any) ;

m) in the 13 - date of the certificate details in the Unified register of issued certificates of conformity and registered declarations of conformity (number - two Arabic numerals, the month - two Arabic numerals, year - by four Arabic numerals);

a) in a field of 14 - the date of the termination of the certificate (number - two Arabic numerals, the month - two Arabic numerals, year - by four Arabic numerals). If the technical regulations (technical regulations) validity of the certificate is not installed, the recording is done, "not installed" in this field;

n) in the field of 15 - signature, name, surname and patronymic (if any) of the head (authorized person) of the certification body and the expert (expert-auditor) (expert (auditors)) with the stamp of the certification authority (unless otherwise established by the legislation of the member state). The use of a facsimile instead of signature is not allowed.

7. With a significant amount of information in the fields 7-9, 11 and 12 of the certificate, such information is contained in the annex to the certificate, which is issued on the letterhead of the application and is an integral part of the certificate. Each application sheet is numbered, put down the registration number of the certificate on it, a signature, name, surname and patronymic (if any) of the head (authorized person) of the certification body and the expert (auditor) (expert (auditors)), this body seal (unless otherwise stipulated by the legislation of the member state). In this case, the respective certificate fields, reference is made to the application (indicating the number of printing the application form).

 

8. Adding to the certificate information is not provided for in this section, as well as the contraction of the words (except generally accepted symbols and abbreviations), and any correction of the text are not allowed.

 

9. Copies of the certificates issued by the applicant are made on sheets of white A4 paper (210 x 297 mm), stamped (unless otherwise stipulated by the legislation of the Member State) and signature of the applicant organization authorized in accordance with the legislation of the Member State (with an indication of names and details of an authorization document). ".

5. A uniform declaration of compliance with the technical regulations of the Customs Union and the rules of its registration approved by the said Decision, worded as follows:

II. Rules of registration of the declaration of conformity with the requirements of technical regulations of the Eurasian Economic Union

1. With the declaration of conformity by the applicants can be registered in accordance with the legislation of the state - a member of the Eurasian Economic Union (hereinafter referred to, respectively, - Member State Union) in its territory a legal entity or natural person as an individual entrepreneur, is a manufacturer or seller or a person authorized by the manufacturer (hereinafter - applicants).

 

2. Declaration of conformity technical requirements of the Regulations of the Union (hereinafter - the declaration) drawn on the white sheets of paper format A4 (210 x 297 mm).

 

3. The declaration is filled in Russian using electronic printing devices, and in case of corresponding requirements in the legislation of the Member State - in the official language of the Member State in which the declaration of conformity.

In the case of completing the declaration on the Russian language and the official language of one of the Member States, it is filled in accordance with paragraph 5 of this section on the different sides of the declaration.

If necessary, the manufacturer's name, its location (address of the legal entity) and address (es) of the place of activity for the production of products (except for the name of the state) and the designation of the product (type, make, model, article, etc.) Can be specified использованием букв латинского алфавита.

4. All field declarations must be filled, except for the case stipulated by the second paragraph of subparagraph "d" of paragraph 5 of this section (in the original numbering of the Declaration missing fields).

 

5. The declaration specifies:

a) in box 1 - inscriptions made in 2 lines in the following order: 1st row - "Eurasian Economic Union";

Line 2 - "Declaration of conformity";

b) Field 2 - a single sign of products on the market of the Eurasian Economic Union;

 

c) in the 3 - full name of the applicant, its location (address of the legal entity) and address (es), place of business (if the address is different) - for a legal entity (hereinafter - the applicant organization) or surname, name and patronymic (if available), place of residence and address (es), place of business (if the address is different) - physical person registered as an individual entrepreneur, as well as the registration

or accounting (individual, identification) number of the applicant, assigned the state registration legal entity or natural person registered as an individual entrepreneur, in accordance with the laws of the Member States, phone number and email address;

g) in the 4 - position, surname, name and patronymic (if any) of the head of the applicant organization or person of the applicant organization authorized in accordance with the laws of the Member States to adopt a declaration of conformity (with the name and details of an authorization document).

If the applicant is a natural person registered as an individual entrepreneur, the field is not filled; d) in the field 5 - product information, including:

name and designation (in cases stipulated by the technical regulations of the Union (the technical regulations of the Customs Union) (hereinafter - the Technical Regulations)) products and (or) other symbol assigned to the manufacturer of the product (at available);

product name (in cases stipulated by technical regulations) (if any);

other information about the product, to ensure its identification (if any);

the full name of the manufacturer and its location (address of the legal entity) and address (es) of the place of preparation of production activity (if the address is different) - for a legal entity and its affiliates which are manufactured products, or the surname, name and patronymic (if available), place of residence and address (es) of the place of production on manufacturing activity (if the address is different) - physical person registered as an individual entrepreneur;

name and designation of the document (s), according to which the products are made (standard, organization standard, specifications or other documents) (if any);

code (s) of production in accordance with the uniform Commodity nomenclature of foreign economic activity of the Eurasian Economic Union;

the name of the object declaration (serial production, a party or a single product). Write "serial production" is made for the production of serial production. For a lot of the product is specified lot size for a single product - the serial number of the product. For a lot of the product and the individual products are specified the details of shipping documentation identifying the batch of products (including its size) or a single product;

e) in the 6 - name of technical regulation (technical regulations);

g) in the 7 - data on documents confirming the conformity of products with technical regulations (technical regulations) (research protocols (tests) and measurements (in cases stipulated by the scheme of declaration of conformity) with the number, the date, the name of the testing laboratory (center) registration number of accreditation certificate (if any)), information about the certificate management system (in cases stipulated by the scheme of declaration of conformity) with the number, date, name of the body for management systems certification, issued the certificate management system, the registration number of the certificate of accreditation, other documents submitted by the applicant as proof of conformity with technical regulations (technical regulations), as well as the application of the scheme of declaration of conformity;

 

h) in the 8 - Designation and standard name included in the list of international and regional (interstate) standards, and in their absence - the national (state) standards, as a result of which, on a voluntary basis, compliance with the requirements of technical regulations (technical regulations) or designation of the sections (paragraphs, subparagraphs) and the name of the standard, where compliance with the technical regulations (technical regulations) can be achieved using the individual sections (paragraphs, subparagraphs) of the standard, not the standard as a whole (in the case of their use), and well as information on other standards and documents (when applied), the terms and conditions of storage (in the cases stipulated by technical regulations), Lifetime (shelf life) or resource production (in cases stipulated by technical regulations) and other information (if any) ;

and) in the 9 - the date of the termination of the declaration (number - two Arabic numerals, the month - two Arabic numerals, year - by four Arabic numerals). If the technical regulations (technical regulations) is not set to the validity of the declaration is recorded to "term is not established" in this field;

a) in a field of 10 - signature, name and patronymic (if any) the natural person registered as an individual entrepreneur, the head of the applicant organization or person of the applicant organization authorized in accordance with the legislation of the Member State, with putting the applicant print ( unless otherwise stipulated by the legislation of the member state). The use of a facsimile instead of signature is not allowed;

l) in the 11 - registration number of the declaration, which is formed in accordance with the legislation of the Member State, indicating the abbreviation "EAEC" (Eurasian Economic Union) and the 2-character alphabetic code of the Member State in accordance with the classifier of the world;

 

m) in the 12 - date of the declaration information in the Unified register of issued certificates of conformity and registered declarations of conformity (number - two Arabic numerals, the month - two Arabic numerals, year - by four Arabic numerals).

6. With a significant amount of information to be entered in fields 5, 7 and 8 of the Declaration, such information is contained in the annex to the Declaration, which is an integral part of the declaration. Every application is numbered list, it shall appear on the registration number of the declaration, signature, name and patronymic name (if any) of the person who accepted the declaration, the applicant's seal (unless otherwise stipulated by the legislation of the Member State). At the same time in the appropriate fields return a link to the application (indicating the number of sheets in the appendix).

 

7. Adding to the declaration of information not covered by this section, as well as the contraction of the words (except generally accepted symbols and abbreviations), and any correction of the text are not allowed.

 

8. Copies of the registered declaration made by a person who took this declaration, on sheets of white paper size A4 (210 x 297 mm), stamped (unless otherwise stipulated by the legislation of the Member State) and the signature of the said person or entity of the applicant organization authorized in accordance with the legislation of the member state (with the name and details of an authorization document). ".
